Law Enforcement & Takedown Policy

SKYiCloud (a subsidiary of SKYRHRG Technologies Systems) is committed to supporting law enforcement agencies (“LEAs”) and protecting the rights of third parties while ensuring the privacy and rights of our customers. This policy details the procedures for submitting data disclosure requests, takedown notices, and our response protocols.

1. General Principles

  • Compliance: We comply with all applicable laws of India, including the Information Technology Act, 2000 (“IT Act”) and the Digital Personal Data Protection Act, 2023 (“DPDP Act”).
  • Jurisdiction: All legal requests must validly issue from a court or authority with competent jurisdiction over SKYiCloud (Murshidabad, West Bengal, India).
  • Notification: Unless prohibited by law (e.g., a gag order), we generally notify customers of legal requests for their data to allow them an opportunity to challenge the request.

2. Information for Law Enforcement Agencies (LEAs)

2.1. Required Documentation for Data Disclosure

To compel the disclosure of customer data (Non-Content or Content), SKYiCloud generally requires:

  • Civil Cases: A valid subpoena or court order issued by a competent Indian court.
  • Criminal Cases: A valid warrant, court order, or formal written request from an authorized police officer (not below the rank of Inspector) under Section 91 of the CrPC, or direction under Section 69 of the IT Act.

2.2. Submission of Requests

LEAs should submit requests via the following official channels:

  • Email: info@skyicloud.com (Subject: “Law Enforcement Request – [Case Reference]”)
  • Physical Mail: Legal Department SKYiCloud House No 1, Sagarpara, Jalangi, Murshidabad, West Bengal, Pin: 742306, India.

Note: Requests sent via email must originate from an official government domain (e.g., @gov.in@nic.in@police.gov.in).

2.3. Emergency Requests

In cases involving an imminent threat to life or serious physical injury, LEAs may request expedited disclosure.

  • Subject Line must imply: “EMERGENCY DISCLOSURE REQUEST”
  • The request must specify the nature of the emergency and why normal legal processes would cause a critical delay.

2.4. Cost Reimbursement

SKYiCloud reserves the right to seek reimbursement for the costs associated with responding to LEA requests (searching, assembling, and copying data), as permitted by law.


SKYiCloud respects the intellectual property rights of others and prohibits the use of our services for illegal activities.

If you believe content hosted by SKYiCloud violates your copyright, please submit a designated notice containing:

  1. Identification of the copyrighted work claimed to be infringed.
  2. Identification of the infringing material (URL or specific location).
  3. Your Contact Info: Address, phone number, and email.
  4. Statement of Good Faith: A statement that you have a good faith belief that the use is not authorized by the copyright owner.
  5. Signature: Physical or electronic signature of the copyright owner or authorized agent.

3.2. Response to Takedown Notices

Upon receipt of a valid notice:

  1. We will review the complaint for validity.
  2. We may temporarily disable access to the infringing material.
  3. We will notify the affected customer and provide a copy of your notice.
  4. Counter-Notice: The customer may submit a counter-notification contesting the claim. If valid, we may restore the content after 10-14 business days unless you provide evidence of legal action.

3.3. Other Abuse (Phishing, Malware, Defamation)

  • Phishing/Malware: Reports of phishing, malware distribution, or command-and-control servers are acted upon immediately. Verified malicious content is suspended without notice.
  • Defamation/Libel: SKYiCloud is an intermediary and generally does not arbitrate defamation claims. We require a Court Order to take down content based on defamation or libel claims.

4. Data Retention

In accordance with CERT-In directions and Indian law:

  • System Logs: We retain system logs (access, firewall, etc.) for a minimum of 180 days.
  • Customer Info: KYC and registration data is retained for a minimum of 5 years after account closure.
